Terms of Service

1. Agreement to Terms

By accessing or using Campaign 360Aware ("the Platform"), operated by Anthony West Inc ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Campaign 360Aware is a web application that generates AI-powered real estate marketing campaigns. The Platform provides campaign strategy generation, AI video asset creation, platform-specific advertising copy, and (where enabled) automated ad distribution across Meta (Facebook and Instagram) and YouTube.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements.

4. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorised use of your account

5. Platform Connections

The Platform may connect to third-party services on your behalf, including:

  • Meta (Facebook/Instagram) — To create and manage advertising campaigns
  • Google (YouTube) — To upload videos and manage ad campaigns
  • Stripe — To process payments

By connecting these services, you authorise us to act on your behalf within the scope of the permissions you grant. You may revoke access at any time through your account settings or the respective platform's settings.

6. Property Listings and Content

  • You represent that you have the right to market any property you submit to the Platform
  • You are responsible for ensuring all property information is accurate and not misleading
  • You must comply with all applicable Australian real estate advertising laws, including the Australian Consumer Law and relevant state legislation
  • Photos and listing content you submit must not infringe on any third party's intellectual property rights

7. AI-Generated Content

The Platform uses artificial intelligence to generate campaign strategies, advertising copy, and video assets. You acknowledge that:

  • AI-generated content is provided as a starting point and should be reviewed before use
  • You are responsible for reviewing and approving all content before it is published
  • We do not guarantee that AI-generated content will be free from errors or suitable for your specific needs
  • AI-generated videos are produced using Google Veo and may contain digital watermarks (SynthID)
  • You retain ownership of approved campaign content, subject to the underlying AI providers' terms

8. Advertising Compliance

When using the Platform to run advertising campaigns:

  • Real estate advertisements on Meta are subject to the Housing special ad category, which restricts certain targeting options
  • You must comply with all platform-specific advertising policies (Meta, YouTube, Google Ads)
  • You are ultimately responsible for the compliance of your advertisements
  • We reserve the right to pause or stop campaigns that violate platform policies

9. Fees and Payment

  • Campaign execution fees are displayed before payment and include a 5% platform commission on total ad spend
  • Payments are processed securely through Stripe
  • You may set an overrun allowance (up to $1,000 AUD) for campaigns that exceed estimated costs
  • If campaign spend reaches your budget cap plus overrun allowance, campaigns will be automatically paused
  • Refunds for underspend will be processed at campaign completion
  • All prices are in Australian Dollars (AUD) unless otherwise stated

10. Limitation of Liability

To the maximum extent permitted by Australian law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to: loss of profits, data, or business opportunities; advertising campaign performance or results; third-party platform outages or policy changes; or AI-generated content errors.

Our total liability for any claim arising from the use of the Platform shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that any advertising campaign will achieve specific results.

12. Termination

We may suspend or terminate your account at our discretion if you violate these terms or engage in activity that is harmful to the Platform or other users. You may terminate your account at any time by contacting us or using the account deletion feature. Active campaigns will be paused upon account termination.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

14. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the revised terms.

15. Governing Law

These Terms of Service are governed by the laws of the State of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
